1. Introduction

Welcome to Chicken Road! These Terms of Service ("Terms") govern your access to and use of the Chicken Road mobile application, website, and services (collectively, the "Service"). By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

Chicken Road is a mobile gaming application that provides users with an entertaining gaming experience based on the classic "chicken crossing the road" concept. Our Service is provided by Chicken Road, Inc. ("we," "our," or "us").

2. Eligibility

You must be at least 13 years old to use our Service. If you are under 18, you must have permission from a parent or legal guardian to use our Service, and they must agree to these Terms on your behalf. By using our Service, you represent and warrant that you meet all eligibility requirements.

5. In-App Purchases

Our Service may offer the opportunity to purchase virtual items or currencies for use within the game ("In-App Purchases"). All In-App Purchases are final and non-refundable, except as required by law. You acknowledge that:

  • In-App Purchases are virtual items with no monetary value
  • You do not own In-App Purchases, but rather receive a limited, revocable license to use them within the Service
  • We may modify or remove In-App Purchases at any time
  • We are not responsible for unauthorized In-App Purchases made using your account

6. Prohibited Conduct

You agree not to:

  • Use our Service for any illegal purpose or in violation of any local, state, national, or international law
  • Violate or encourage others to violate the rights of third parties, including intellectual property rights
  • Upload or transmit viruses, malware, or other types of malicious code

The Chicken Road name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Chicken Road, Inc. or its affiliates. You may not use such marks without our prior written permission.

IN NO EVENT SHALL WE, OUR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICE, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA OUR SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold harmless Chicken Road, Inc., its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to our Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.

We may revise these Terms from time to time. The most current version will always be posted on our website. If we make changes that we believe are material, we will notify you through the Service or by sending you an email or other communication. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You and we agree to submit to the personal and exclusive jurisdiction of the courts located in San Francisco County, California.
